Traffic attorney

A traffic attorney , also a correspondence attorney , is a lawyer who acts in addition to the procedural or principal authorized representative in court proceedings. His mandate is limited to the management of the client's dealings with the authorized representative (No. 3400 of the VV remuneration list for the RVG ).

Since the simultaneous approval was discontinued in 2007, the activity as a traffic attorney is particularly important when a lawyer is not capable of submitting a position at the trial court of a higher court , in particular in an appeal procedure at the Federal Court of Justice in civil matters ( Section 78 (1) sentence 3 ZPO) . The lawyer approved by the Federal Court of Justice then acts as a legal representative for the revision instance, and the lawyer who was active in the lower instances as a traffic lawyer. He maintains contact with the authorized representative for the client in writing or by telephone.

If, on the other hand, the assignment is limited to representation in a judicial or extrajudicial appointment, one speaks of appointment representative (No. 3401 VV). This can be called in, for example, if the authorized lawyer is not based at the place of the competent court and if he attends an external court hearing in person, high travel costs and absence allowances for a business trip as well as other expenses would be incurred (No. 7003 ff. VV).
