The Soergel is a large commentary on the German Civil Code (BGB) with an introductory law and ancillary laws . It is published by Kohlhammer Verlag .

background

The commentary on the Civil Code was justified in 1921 by the Bavarian lawyers Hofrat Hans Theodor Soergel and Senior Justice Councilor Lindemann. With the new commentary, they were particularly keen to compile the “relevant decisions and results of case law and legal doctrine in full”, and resorted to Praktiker as employees.

In its first edition, the commentary was limited to two volumes (Volume 1: General Part, Law of Obligations; Volume 2: Property Law, Family Law, Inheritance Law, Introductory Act) and was able to keep this scope for a few editions, and then soon to add another Band to grow. The 8th edition (1952 ff.) Published after the war then already comprised four volumes and continued the previous tradition of extensive casuistry with explanations. For the first time, not only practitioners but also scientists worked on this edition, including the Heidelberg law professor Wolfgang Siebert . Together with specialist colleagues, Siebert developed a new concept which retained the tried and tested peculiarity of the commentary “to compile the relevant decisions - also from the practice of the lower courts - as completely as possible”, but also placed great emphasis on working through the scientific literature and on the scientific Participate in conversation yourself. This concept was implemented with the 9th edition (1959 ff.). The commentary, which has now grown to six volumes, then appeared for two editions under the name Soergel / Siebert . It developed into a “complete and systematically streamlined presentation of all legal material that is equally useful for both practice and science”, which was able to make its contribution to the further development of civil law and to the clarification of disputes in the following years.

The commentary had to take account of the increased codification of civil law matters in independent laws and to open up to these subsidiary laws. This and the increasing striving for individual justice, which is reflected in the number and scope of court decisions, steadily increased the scope of the overall commentary. The 12th edition comprised twelve larger volumes. This tendency intensified in the following years and in order to keep the individual volumes in a manageable size, the 13th edition (2000 ff.) Was made up of 32 volumes.
