Spoof suit

The Spolienklage (from the Latin spolium , which has been used since the Middle Ages in the sense of deprivation of property) is the action for the return of property, introduced by canon law and adopted by civil law .

By means of the spoof defense, the defendant was able to avert any complaint by the spoliator (the person who had taken possession of property) concerning another object until he had recovered the thing that had been forcibly taken from him.

The German Civil Code does not recognize both expressions.
