Urban development contract

The urban development contract is a means of cooperation between the public sector and private investors. It is usually closed in connection with a development plan procedure .

Urban development contracts are regulated in the Building Code in Section 11 of the BauGB and represent a special form of public law contracts . They serve to fulfill urban development tasks; they thus complement the sovereign instruments of urban planning law . If, on the other hand, the municipality simply acts as the buyer or seller of a property, it is usually a private property purchase agreement .

Urban development contracts can be divided into measures, target-binding and follow-up cost contracts. They must comply with the principle of appropriateness (principle of proportionality ), must not contradict the prohibition of coupling and must be in writing.

Frequent special forms of urban development contracts are the implementation contract in the project and development plan according to § 12 BauGB and the development contract according to § 11 para. 1 sentence 2 No. 1 BauGB (formerly § 124 BauGB old version).
