Structural crisis cartel

Structural crisis cartels are cartels that are formed by companies in phases of a difficult economic environment within an industry.

According to the German Act against Restraints of Competition (GWB), the Federal Cartel Office was able to approve such a cartel so that companies could adapt to sustainable changes in demand. The cartel members had to bring about a planned adjustment of capacity to requirements. The conditions of competition in the industries concerned must be taken into account in the agreements.

In Germany, for example, the steel industry and shipyards were affected by this regulation.

The regulation previously provided for in Section 6 GWB no longer applies with the 7th amendment to the GWB in 2005.
