System builder

The term system builder or German system manufacturer refers to a manufacturer or specialist dealer who sells a preconfigured personal computer with pre-installed software. This is in contrast to a consumer who puts his own PC together from individual components.

System Builder Versions are special software products that are sold to System Builders through authorized distributors. The products are usually cheaper and also offer pre-installation tools. The license agreement can, however, stipulate that the support is not provided by the manufacturer but by the intermediary.

Microsoft sells system builder versions of its Windows operating systems to end customers in the countries of the European Union, in Switzerland and in the Principality of Liechtenstein.

With Windows 10 digital licenses are issued that are suitable to prevent the resale of the licenses; these licenses can still be read out. According to a BGH judgment of July 6, 2000, dealers in Germany are allowed to sell OEM versions without being tied to hardware. According to the principle of exhaustion , the manufacturer gives up control of the goods sold with the sale and is therefore no longer entitled, according to the BGH, to restrict the free movement of goods.
