Partial termination

A partial termination is a special form of termination of continuing obligations (z. B. tenancy or employment contracts ), the contract will be terminated when only individual components.

Partial termination is not permitted if the contract does not explicitly provide for partial termination. This makes sense because all agreements within a contract are related.

Tenancy law

In the case of residential rental contracts, partial termination of the apartment is generally not possible; under certain conditions, the landlord is entitled to partially terminate rooms or areas that are not used for residential purposes (basement, attic, storage room, garages, parking spaces, etc.). However, this is only permitted if the landlord needs these rooms or areas (e.g. landlord terminates the attics in order to be able to expand the attic). In such cases, the tenant can demand an appropriate reduction in rent. With this partial termination, the three-month notice period § 573b BGB always applies .
