Constitutional Council of Ethiopia

The Ethiopian Constitutional Council ( Amharic የሕገ መንግሥት ጉዳዮች አጣሪ ጉባኤ , transcribed Ye hege mengist goudayoch at'ari goubaé ) is a political body that was established by the constitution of the Federal Democratic Republic of Ethiopia from 1995 (according to Article 82, paragraph 1 of the constitution) .

The organizational structure is worked out by the council itself in order to ensure the speed of its activities (Art. 82, Para. 3). It drafted its rules of procedure and sets them to the approval of the Federal Parliament into action (Art. 84, para. 4). The Constitutional Council is instructed to consider and examine the disputes relating to the constitution.

composition

The Constitutional Council consists of eleven members (Art. 82, Paragraph 2):

  • The President of the Supreme Federal Court of Justice , who at the same time holds the post of President of the Constitutional Council (Art. 82, Paragraph 2 a);
  • The Vice-President of the Supreme Federal Court of Justice, who holds the post of Vice-President of the Constitutional Council (Art. 82, Paragraph 2 b);
  • Six lawyers that following the recommendation of the People's House of Representatives are appointed by the Ethiopian Federal President (Article 82, paragraph 2 c..);
  • Three persons, who are designated by the members of the Ethiopian Parliament (Art. 82, Para. 2 d)

Functions

The Constitutional Council has the power to examine the disputes about the constitutional order, it can postpone recommendations of the People's House of Representatives if it considers it necessary to declare the constitution of Ethiopia (Art. 84, Paragraph 1). The issues in dispute are resolved by the Federal House of Ethiopia (Art. 83, Paragraph 1). He must decide the question within the following 30 days (Art. 83, Paragraph 2). As soon as a federal law, a law passed by the federal government or a law passed by a region is considered to be unconstitutional by a court or a party, the Constitutional Council must question the established norm and submit its judicial assessment for the very last decision to the Bundestag (Art. 84 , Paragraph 2).
