Procurement manual

Procurement manual is the collective term for the various terms used by the public sector in Germany handbooks for the award of various services in connection with the execution of construction projects.

Federal building construction

The procurement and contract manual for federal construction measures (VHB 2017) is used by the ministry responsible for federal construction (currently the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety - BMUB - based in Berlin) as a tool for the processing of construction projects in construction , which are managed by the federal building authorities issued. It was introduced with a decree of the BMVBS from June 2, 2008 to July 1, 2008 and is updated regularly.

Part I consists of the guidelines , de facto implementing provisions for the VOB . Part II are the uniform contract samples with forms for the award procedure, from the invitation to submit an offer to the placing of an order. Part III contains the standard forms for all other processes, from the notification to a bidder that his offer will not be commissioned to the notification to the contractor that the final payment has been made.

The forerunner was the procurement manual for the implementation of federal construction tasks in the area of ​​responsibility of the financial construction authorities (VHB 2002) , which was regularly updated.

Federal road and bridge construction

The handbook for the award and execution of construction works in road and bridge construction (HVA B-StB) is used by the Federal Ministry of Transport and Digital Infrastructure , Road Construction Department (based in Bonn) as a tool for handling federal construction projects in road and Bridge building published. The last version (HVA B-StB 04-16) was introduced with the General Circular Road Construction (ARS) No. 07/2016 of April 12, 2016.

The HVA B-StB is divided into

Part 1: Guidelines for the preparation of the tender documents,
Part 2: Guidelines for the implementation of the procurement procedure,
Part 3: guidelines for the execution of contracts,
Forms: Forms for procurement documents, procurement procedures and contract processing as well
Appendix: Supplementary documents.

The BMVBS, Department S, has also published:

  • Manual for the allocation and execution of deliveries and services in road and bridge construction (HVA L-StB)
  • Handbook for the award and execution of freelance services by engineers and landscape architects in road and bridge construction (HVA F-StB)

Procurement manuals of the countries

Strictly speaking, the VHB and the HVA B-StB as well as the HVA L-StB and the HVA F-StB only apply to federal construction projects. Most of the federal states have introduced the manuals with more or less extensive changes for their own building authorities. Since it offers a high degree of legal certainty, the VHB is occasionally also used in the private sector (since the private sector does almost no road construction, this does not apply to the other manuals).

Contents of the manuals

The procurement manuals have largely the same or at least similar content. However, the relative independence of the departments of the BMVBS seems to dictate that separate manuals are written, published and regularly updated. The federalism seems to command that the countries repeat these operations on their own and self-responsibility.
