Enticing a subordinate to commit a crime

In German criminal law , inducing a subordinate to commit a crime (also: connivance ) is punishable under Section 357 of the Criminal Code. The offense is a superiors met or inspectors, who tried, a subordinate to an offense to induce, or can be done the act of the subordinates.

The connivance is one of the official offenses . It acts with the same threat of punishment as the offense committed by the subordinate. The act itself must take place while performing the service. Seduction, the undertaking to induce or letting the act occur are sufficient for the implementation of Section 357 of the Criminal Code. This covers almost all forms of criminal participation ( incitement , aiding and abetting, attempted incitement and aiding and abetting through omission), but not the indirect or complicit execution of the offense. On the subjective side of the facts , intent , even if only contingent , is required. As a side effect, the loss of the capacity to act according to § 358 , § 45 StGB is possible.
