Defamation (Austria)

In Austrian criminal law, defamation occurs when someone exposes another person to the risk of official prosecution by suspecting him of an official offense or of breaching an official or professional obligation if he knows that the suspicion is false.

As a criminal offense against the administration of justice, defamation is an official offense and is regulated in Section 297 of the Criminal Code. It is threatened with imprisonment for up to one year or a fine. If the accused criminal offense is threatened with a prison sentence exceeding one year, the range of punishment for the defamation increases to five years.
