Asset collapse

In some ( § 31 GVG ), in particular some professional laws (e.g. BRAO , StBerG ), the situation in which a person concerned (potential lay judge , lawyer , tax advisor ) is in disordered, onerous financial circumstances is referred to as asset deterioration he will not be able to regulate in the foreseeable future and he will be unable to meet his obligations.

In the event of a financial collapse, the person concerned is threatened with revocation of the professional license. B. with the opening of insolvency proceedings according to § 14 Abs. 2 Nr. 7 BRAO and § 46 Abs. 2 Nr. 4 StBerG is presumed rebuttable.
