Administrative jurisdiction in the Republic of Azerbaijan

The administrative judiciary ( Azerbaijani : İnzibati-İqtisadi Məhkəmə ) is the branch of the Azerbaijani judiciary, which serves the judicial control of the actions of the public administration.

Legal basis

The legal basis of the administrative judiciary in Azerbaijan was created for the first time with the adoption of the Law "Confirming the New Code of Administrative Procedure of the Republic of Azerbaijan". On June 22nd, 2010, a new law entitled “Reform Measures for the Further Development of the Judicial System and Changes to the Law on Courts and Judges and Changes to the Law on the Judicial Council” was passed. As a result, the judicial structures for administrative justice in Azerbaijan were established.

On January 1, 2011, the new Code of Administrative Procedure came into force, which laid down the procedural principles and rules for the procedure in administrative disputes.

Jurisdiction

The administrative courts are responsible for disputes under public law . According to Article 67 (2) of the Administrative Procedure Act, an unlawful administrative act can also be repealed by a court.

The administrative judiciary in Azerbaijan gives citizens a chance to defend themselves against state measures. In 2011 alone, 6,818 lawsuits were brought before the administrative courts and in around 84% of the cases the administrative courts declared public authority actions to be illegal.

The administrative court is the first instance responsible for administrative proceedings. The appeal bodies of the administrative courts are the general appeal courts of the Republic of Azerbaijan. A Senate for administrative matters of the Supreme Court decides on appeals against judgments of the administrative courts. It is based in Baku . The Azerbaijani administrative courts correspond to the German administrative courts.

The administrative court procedure is generally chargeable.

There are seven administrative courts in Azerbaijan (as of 2018):
