As a military organization the whole of the military affairs of the country concerned (constitutional) norms is called; In particular, this refers to the amendments to the Basic Law passed in the Federal Republic of Germany in 1956 - with a view to the establishment of the Bundeswehr in the previous year . In the sense of distinguishing between
- Constitutional law and ordinary law in general
such as
- Defense Constitution and, for example, Soldiers Act in particular
the military constitution is only a part of military law .
In 2015 Dieter Weingärtner wrote: “The military constitution [...] does not form a separate section in the Basic Law. Rather, the provisions that affect the Bundeswehr are divided into various articles that are scattered across almost the entire constitutional text. The ' Emergency Constitution ' was added in 1968, which regulates, among other things, the role of the armed forces in domestic emergency situations. Apart from this, the military constitution has remained practically unchanged since 1956. "
