A work delivery contract is a contract that has the delivery of movable objects to be manufactured or produced . According to § 650 BGB , the provisions of the sales law apply to such contracts .

Section 651 of the German Civil Code a. F. was adopted unchanged in § 650 BGB.

In principle, according to the law that has been in force in Germany since the modernization of the law of obligations , it is irrelevant whether the procured material is a justifiable or unjustifiable thing. In contrast to the previous version, the standard no longer differentiates according to who procured the material to be processed. According to § 650 BGB, the provisions of sales contract law are regularly applied. Only in cases of non-justifiable items are some rules of the law on contracts for work and services also apply, whereby the provisions of sales law take the place of acceptance for the transfer of risk .

Application examples for the application of sales law in the contract for work and services are the production of objects that are later to be incorporated or built into the customer. The main area of application for work contract law is the work that is carried out on immovable property.
