A work apartment (also: Werkswohnung ) is an apartment that is rented by an employer to an employee or other service provider, especially in view of the employment or employment relationship .

The German tenancy law knows some special features for works or works service apartments, which are regulated in §§ 576 - 576b BGB. These special regulations concern the easier termination of such apartments. Since the employer has an interest in being able to make the apartments available to his employees in particular, the general difficulties of dismissing the apartment rental should not apply in the event of termination of the employment relationship.

In general, the employer can terminate company apartments upon termination of the employment or employment relationship up to the third of a month with effect from the end of the month after next, and also at the end of the current month in the case of apartments that are needed for a successor due to their special location in the place of employment.

Otherwise, in deviation from other tenancy law, the employer's concerns must also be taken into account in the event of an objection to the termination.

Deviating agreements, which would work to the disadvantage of the tenant, are ineffective because the special regulations already represent a deterioration in tenant protection.
