A yacht charter is the provision of sailing or motor yachts for a certain period of time. The ship owner rents out his yacht for a charter fee, which usually has to be paid before the trip. A charter contract is concluded that regulates the obligations of the charter company and charterer.

Charter types

A charter yacht can be rented either directly from the organizer or through a travel agency specializing in yachting holidays (yacht charter agency).

Crewed Charter

With the "crewed charter", in addition to the charter yacht, the on-board personnel are also hired by the charterer. The staff consists of a skipper who controls the yacht and (depending on the needs of the charterer) other staff such as cooks or hostesses . Since the skipper is responsible for the yacht, the charterer is usually not liable for any damage.

Berth charter

If the charterer does not rent the entire yacht, but only a single berth for a fee, it is referred to as a berth charter . The charterer is then involved in the trip planning, but the liability under the law is borne by the skipper, possibly together with the shipowner who owns the ship and who rents the berth and organizes the trip. With the special form of the berth charter "hand-against-bunk", it is customary that the fellow traveler does not pay rent for the ride, but instead takes on work in return in the form of tasks arising on the boat. However, it is still common for the fellow traveler to contribute to the board cash.

Bareboat charter

If the charterer rents a complete yacht but waives the booking of additional on-board personnel, this is referred to as a " bareboat charter ". The charterer provides the skipper himself and is liable for any damage in accordance with the concluded charter contract.
