Civil solidarity pact

The civil solidarity pact is a possible civil law partnership which , in addition to a classic marriage, regulates state and legal affairs between two partners. France pioneered this new civil act in 1999.

France

The civil solidarity pact (also PACS [ paks ] from the French pacte civil de solidarité ) is a civil law partnership , joint tax assessment and tax-favorable inheritance provisions possible in France since 1999 . Since 2007, the partners have been able to choose between the separation of property and community of property both when the solidarity pact is concluded and at a later point in time.

It does not depend on the sexual orientation or the gender of the partner. In 95% of cases it is entered into between partners of different sexes. For homosexual couples it was the only possibility of an officially recognized partnership until 2013; only since then has the right to marry in France been extended to same-sex couples.

In contrast to marriage , the PACS is not concluded before the mayor, but before the local court. Since the law allows mayors to celebrate any PACS in the town hall, some mayors, mostly left-wing parties, have decided to hold a ceremony for every couple who closes a PACS and wants the mayor or the city council to recognize it.

The partnership obliges to mutual help, whereby the partners have the freedom to arrange these assistance obligations individually in detailed questions. Joint child adoption is not permitted. According to French law, however, child adoption is permitted by an individual.

Chile

On April 13, 2015, Michelle Bachelet , the incumbent president of Chile, announced the Acuerdo de Unión Civil (AUC) law, which will come into force after six months, which are required for administrative changes. The law regulates the establishment and the legal status of communities that are to be closed at the registry / registration offices (registro civil). In addition to the legal protection, such as illness or inheritance of the partner, children who are shared or brought in with the partner (stepchildren) are also included in this protection. The dissolution of the community also takes place with mutual consent at the registry / registration office, where contracts on pension, maintenance payments and the legal guardianship of children must be signed. In the event of unilateral cancellation, a civil judge must be involved. The law of adoption is not affected by this law.

Austria

The PACS is a model for the civil pact , a legal initiative of the Austrian Greens on partnership.

Switzerland

In its report on family law in April 2015, the Swiss Federal Council proposed the introduction of the PACS as an alternative to marriage in Switzerland.

Luxembourg

The PACS was introduced in Luxembourg in 2004.
