Main defect
As a major deficiency (also main responsible shortage ) are cattle diseases and equine diseases referred to, which were subject until 1 January 2002 purchase of a special law.
Since the modernization of the law of obligations in the course of the EU harmonization, these provisions have been deleted without replacement on January 1, 2002. Today the same warranty applies to the cattle trade as to things . A purchase inspection is still recommended.
meaning
The regulation was to be found under Sections 481 to 492 of the old version of the German Civil Code (BGB) and in the Imperial Ordinance on Major Defects and Warranty Periods in Cattle Trade of March 27, 1899 .
The special regulation provided that the seller of an animal was only responsible for certain main defects and only if they appeared within the so-called warranty period (14 days for horse diseases). The buyer could then demand that the purchase be reversed ( conversion ) if he asserted the defect in good time (notification of the defect no later than 2 days after the warranty period has expired or after the animal has died before; limitation period 6 weeks after the warranty period has expired).
