It is very improbable that the yahoo user that posted it on the group owns the copyright for the photography. http://www.oomyungdoe.com/graphics/csnapple.jpg while not being the exact same image shows clearly the same shot (note that I am unable to access the Yahoo! I've done quite a bit to fix the rationale up. I am afraid I am still learning a bit about how to load images onto wikipedia. The images are from materials copyrighted by Oom Yung Doe, LLC, as I've indicated on the rationale.

You correctly noted that both of the images are very similar but not the same. The reasoning for having two such similar photos is relevant to the article. At any rate, even though they are basically the same, I've tried to provide information about where each of them comes form. Hope that keeps them from being deleted. Both of the images in this derivative are copyright Oom Yung Doe, LLC and can be found on the official website. Neither has been released to the Public Domain. Per Wikipedia policy, this image must be deleted. 209.247.21.147 (talk) 02:42, 10 October 2008 (UTC)

The template says it needs to pre 1923, but the file name and cover of the magazine say 1924.[1] It was originally {{PD-old-50}} I'm not sure where that applies, or if I should revert to that version or not, but the current template is illogical. dvdrw 20:44, 8 October 2008 (UTC)

It's an issue of Kurt Schwitters' Merz, designed by El Lissitzky. As a German publication, it would fall into the public domain 70 years after the death of the author. Neither Lissitzky nor Schwitters has been dead 70 years. --dave pape (talk) 02:34, 9 October 2008 (UTC)
