Element moral

As élément moral (also élément subjectif, élément psychologique or élément intellectuel ) in the criminal law of France, besides élément légal and élément matériel, a prerequisite for criminal liability is designated . The élément moral should justify the moral reproach to the perpetrator. This does not apply, for example, if the mental state of the offender (minority, mental disorders) or errors of the offender so require.
