The Convention on the Status of Stateless Persons defines someone as stateless who does not have citizenship because no state recognizes them as its national.
This convention was created by the UN, because the convention of July 28, 1951 on the status of refugees does not cover all stateless persons and they can therefore not exercise their rights.
Subject of the Convention
The 1954 Convention recognizes the international legal status of “stateless person” and contains the definition of the term “stateless person” under international law as “a person who no state regards as a national by virtue of its law”. This definition is now recognized by customary international law. The convention is based on the core principle that stateless persons should not be treated in a worse position than foreigners who have citizenship. The Convention also recognizes that stateless persons may be more vulnerable than other foreigners.
