Amendment procedure

An amendment procedure is a procedure for changing judicial decisions .

The term is used in particular for the procedure before the family court for the purpose of amending legally binding decisions on pension equalization.

In general, there is an action for amendment pursuant to Section 323 of the German Code of Civil Procedure (ZPO) in the case of a conviction for future payments due in the event of a significant change in the relevant circumstances .

In administrative law , one speaks of an amendment procedure if a decision is changed in the context of temporary legal protection (on the order or restoration of the suspensive effect of an objection ) (cf. § 80 para. 7 VwGO ).
