The demolition requirement is the right of a municipality to remove a building if the building does not meet certain conditions. These conditions are specified in Germany in the dismantling and unsealing requirement according to § 179 Building Code (BauGB) and in Austria in various building laws, for example in the Salzburg Regional Planning Act, Section 3, Part 4, Section 059 Maintenance and Demolition Bids. Accordingly, the building does not comply with the stipulations of the development plan and cannot be adapted to them or it has grievances and deficiencies (in Germany according to Section 177 (2) and (3) sentence 1 BauGB) that cannot be remedied by repairs or modernization .
