Waste officer

A waste officer or company representative for waste advises the entrepreneur or operator of a plant and the employees in matters that can be important for the circular economy and waste disposal . He is one of a series of " operating officer of the company" as in Germany are regulated for various activities and purposes; his appointment, his tasks and the personal demands on him are determined by law and ordinance.

The waste officer acts as a consultant in matters of circular economy, in particular waste avoidance and recycling, as well as waste disposal. Legal basis

The basis is § 59 and § 60 Recycling Management Act (KrWG); Section 59 determines the group of those who have to appoint one, and Section 60 determines what he is appointed for, i.e. his tasks.

The federal ministry authorized by the KrWG regulates the persons obliged and the requirements for those who must and can appoint them with the ordinance on operational representatives for waste (Waste Commissioner Ordinance - AbfBeauftrV). In Section 2, it describes the requirements for the waste officer, namely in particular reliability ( Section 8 ) and specialist knowledge ( Section 9 ). There are also regulations in Section 55 of the Federal Immission Control Act.

The enforcement aid for the disposal of waste from facilities of the health service of the Federal / State Working Group on Waste (LAGA) formulates the need to carefully select the company representative for waste.

Obligation to order

Section 59 of the KrWG, in conjunction with Section 2 (1) of the Waste Commissioner Ordinance, determines those operators of waste facilities, in particular of (hazardous) facilities that require approval under immission control law and of facilities in which hazardous waste is handled, as well as operators of take-back systems and points (within the scope of product responsibility , from § 23 KrWG) who have to appoint a waste officer. The type of waste, quantities and the company's branch are decisive.

Against the obligated person, i.e. d. Fines are to be imposed on the managing director and, if applicable, the legal entity who negligently neglect the appointment.

Personal demands on him

Waste officers must be reliable within the meaning of the AbfBeauftrV. Corresponding exclusion criteria can be found in Section 8 (2). Furthermore, they must meet the requirements for specialist knowledge according to Section 9 (1) of the AbfBeauftrV. Professional qualifications, work experience and participation in courses are the basic requirements here. In addition, there is a continuous training obligation for waste officers. An officially recognized course must be attended at least every two years. According to Appendix 1 to Section 9 of the AbfBeauftrV, knowledge of waste law and waste technology (including law, occupational safety, liability, disposal) and knowledge of the position of the waste officer (rights, obligations, appointment) should be conveyed.
