Adventicia

Adventizien is a term from the old law. This is about the ability of the home child, the guardian (usually the father) managed genutznießt was. In the Prussian land law the Adventizien were referred to as "not free property".

The Romans designated the contrast to the Adentizia in Roman law

  • on the one hand as profectizia , that which comes from the father and remained with him according to his current law (this was no longer practiced later),
  • on the other hand as adventicia irregularia and extraordinaria , that is the free property not subject to paternal authority

The German Civil Code made it accessible not only to paternal but also to parental authority - including the influence of the mother. Free property is what it calls the property that is excluded from the parents' usufruct.
