General flat fee

The general flat-rate fee , also known as a flat-rate fee , is a flat-rate amount that is independent of evidence and that can be awarded to victims of a traffic accident by the case law for reasons of practicability in accordance with Section 287 ZPO . The amount of the lump sum is between 15 and 50 euros, depending on the judicial district, and averages 25 euros.

The general flat rate applies to expenses that are incurred in direct connection with a traffic accident but are not directly attributable to vehicle damage or other damage to property or health, in particular small postage, telephone and travel costs associated with the accident. If the injured party wants to claim higher costs, concrete evidence is required.
