The official operation is a process maxim , according to which the initiation and the progress of a procedure as well as the necessary investigations have to take place ex officio regardless of the corresponding applications of the parties involved. The most important examples are the official maxim applicable in criminal proceedings and the principle of investigation in administrative court proceedings. The official operation also applies in the procedure of voluntary jurisdiction .

In civil litigation, on the other hand, party operations are seen as the outflow of the disposition maxim . According to this, the initiation and progress of the procedure depend on the respective process actions of the litigants .
