Decency violation

In Austria, a violation of decency is a behavior that represents a gross violation of the generally recognized principles of propriety that must be observed in public . Showing such behavior is a criminal offense under administrative law, the penal norms are regulated in the respective state police and state security laws of the federal states in connection with the administrative penal law. The prerequisite for criminal liability is that the criminal behavior occurs in public, i.e. in a group of people that is not restricted in advance. This means that beyond the circle of those involved, other people have the opportunity to perceive the behavior. Examples of decency violations include: For example, urinating in public, chanting the slogan " ACAB " or showing your finger . The penalties for violations of decency are primarily carried out or initiated by organs of the federal police . The issuance of an organ penal order is considered the minimum penalty . In 2009 and 2016, the media picked up cases from Vienna and Graz in which young men belched or farted loudly in the presence of police officers and were sentenced to fines of 70 and 50 euros, respectively.
