Technical rules for workplaces

The technical rules for workplaces (also known as workplace rules or ASR for short ) specify the requirements of the regulations applicable in Germany for workplaces . They are drawn up by the Committee for Workplaces (ASTA) and come into force after publication by the Federal Ministry of Labor and Social Affairs in the Joint Ministerial Gazette (GMBl).

The technical rules serve to clarify the requirements of the workplace ordinance. For example, ASR A4.1 “Sanitary rooms” provides specific information on the number and design of the toilets, washrooms and shower facilities required.

If the technical rules are complied with, the employer can assume that the relevant requirements of the ordinances are met (presumption of conformity). However, the employer is not obliged to adhere to the technical rules. If he chooses a different solution in the context of a risk assessment, he must however achieve at least the same level of safety and health protection for the employees.

According to § 8 of the amended Workplace Ordinance of August 12, 2004, the earlier workplace guidelines have become invalid since the beginning of 2013. Only the ASR 7/1 "visual connection to the outside" and the ASR 25/1 "seating" have not yet been revised by the ASTA. However, the information in these two sets of rules that have become invalid can still be used as "orientation values" to specify the general protection objectives of the ordinance when setting up and operating workplaces. However, the user must note that the content of these old workplace guidelines no longer reflects the state of the art.

ASR A5.2 was passed by the Committee for Workplaces on December 5, 2013. However, it was not published in the Joint Ministerial Gazette in April 2014, as there was still a need for coordination on the guidelines for securing workplaces on roads (RSA 95). It was therefore not yet valid and had no presumptive effect. However, in April 2014 it was made available to the specialist public as "state of the art". After minor changes to ASR A5.2, it finally came into force when it was published in the Joint Ministerial Gazette on December 21, 2018.

The ASR are controlled by the occupational health and safety authorities (including, for example, trade supervisory offices ) in the federal states. These controls are often carried out unannounced and, if the regulations are not complied with, orders that are binding on the employer or, in particularly serious cases, can even result in the plant and machinery being shut down.
