The Elevator Ordinance is based on Section 8 of the Product Safety Act .

It is not a new version of the regulation on elevator systems (Elevator Ordinance - AufzV) that expired on January 1, 2003, which was issued on the basis of the earlier Section 24 of the Trade Regulations and whose provisions have largely been replaced by those of the Industrial Safety Ordinance (BetrSichV). The technical rules for elevators (TRA) continue to apply as technical rules for operational safety (TRBS) in accordance with the transitional provisions in Section 27 (4) BetrSichV until they are revised .
