A contractual exclusion clause is a clause in labor law that shortens the statutory limitation period for a claim .

Synonymous of committee clauses are sunset clause , preclusion clause and forfeiture clause . Exclusion clauses can be found in collective agreements , employment contracts , rarely in company agreements . If exclusion clauses are regulated in employment contracts, these are usually general terms and conditions . In this case, the effectiveness of the clauses is assessed in accordance with Sections 307 to 310 BGB . According to this, exclusion clauses must not be surprising or intransparent or, contrary to the principles of good faith, unreasonably disadvantageous. The ineffectiveness of an exclusion clause can result e.g. B. result from the fact that the claim to the statutory minimum wage according to § 3 sentence 1 MiLoG is not expressly excluded from the scope.
