Selection fault

Choice fault ( Latin culpa in eligendo ) is a term from the law of obligations . It describes the facts if the debtor has engaged a third party in fulfilling his obligation , who is clearly unsuitable or whose involvement is at least associated with recognizable risks. If the risk associated with engaging the third party occurs, the debtor is liable for this through his own fault. In contrast to vicarious agents , it is not about the attribution of third-party fault, but about the debtor's own fault.
