Zoning plan

The zoning plan in its version of December 28, 1960 is a preparatory master plan for West Berlin within the meaning of § 5 BauGB . In connection with the building regulations for Berlin of November 21, 1958 and formally established building alignment lines, it is considered a qualified development plan . It contains transferred planning law that is still binding today .

The zoning plan defines the type and extent of structural use. These specifications are specified in the provisions of the 1958 building regulations, for example on the permissibility of the type and extent of use as well as the permissible building depth or the building height. Even today it forms the basis of planning law decisions in the western districts of Berlin, provided that no more recent planning law z. B. consists of a development plan.

The specifications of the building use plan with regard to the degree of structural use are limited to 1.5 for heavily dense inner city areas with regard to the floor area number (GFZ). The building stock in the inner city area usually has a GFZ of 2.0 to 4.0. In official approval practice , an exemption is therefore often granted in accordance with Section 31 of the Building Code (BauGB).

The planning principles of the zoning plan are therefore no longer a yardstick for urban development and order. It has lost its control function, especially for the inner city.
