from Wikipedia, the free encyclopedia

The certificate of entitlement is a document under mining law that is presented to a miner when mining property is granted . It consists of the award certificate, the so-called award certificate , and a copy of the location map .

formalities

The certificate of entitlement may only be served on the applicant when the decision to lend mine ownership has become incontestable. The mine ownership applied for by the applicant arises through the delivery of the certificate of eligibility. According to Section 17 of the Federal Mining Act, the award certificate must contain the following information:

  1. Name and place of residence of the mine owner (beneficiary)
  2. Name of the mining property
  3. precise details of the size and delimitation of the mine field with reference to the map
  4. Names of the communities in which the mine property is located
  5. Designation of the mineral resources to which the mine ownership applies
  6. Date of the certificate as well as seal and signature

If a permit under mining law was previously valid for the area of the mine field, this expires when the mine ownership arises. The responsible mining authority asks the land registry to enter the mine ownership into the land register. For this purpose, a certified copy of the eligibility certificate is attached to the application.
