The Federal Law on the Principle of the administration ( Transparency Act , short form of Information Act ), the Freedom of Information Act of Switzerland . The law is dated December 17, 2004 and entered into force on July 1, 2006.
According to this, all persons generally have access to all information and documents of the federal administration. However, this does not apply if, in particular, the privacy of third parties could be violated or Switzerland's security could be endangered.
The Federal Data Protection Officer, who is now called the Federal Data Protection and Information Officer, is responsible for monitoring compliance with the statutory regulations . Sample letters for inspection requests are published on its website.
At the end of 2007, the Foundation for Consumer Protection described the implementation of the law as unsatisfactory. Since then, thanks to court rulings, a practice has established itself that gives the law more consideration, with the various authorities handling requests to inspect files very differently. Attempts to deter applicants by means of excessive fees have stopped decisions by the Federal Administrative Court and the Federal Court. Compared to similar laws in other countries, however, the BGÖ remains little used.
