The Bureau d'enquêtes sur les accidents de transport terrestre (BEA-TT) ( German  investigation center for accidents in land transport ) is a French national investigation authority for accidents in land transport and inland waterway transport .

history

France has had an investigative authority for aviation accidents since 1946, the Bureau d'enquêtes et d'analyses pour la sécurité de l'aviation civile (BEA), and since 1997 , the Bureau d'enquêtes sur les événements de for accidents in the maritime sector mer (BEAmer). However, until 2004 there was no corresponding authority for land transport and inland waterway transport. In the event of serious accidents in these areas, the Ministry of Transport set up an ad hoc investigation commission if necessary .

The experience gained in this practice, in particular from the severe fire in the Mont Blanc tunnel in 1999, finally prompted the government and legislators to create an authority for land transport, including inland waterway transport, corresponding to the BEA and BEAmer. In 2002 a law was passed according to which the relevant investigations were to be carried out by a permanently staffed position specially created for this purpose. The law gives this authority the right of access to all relevant information, including information that is subject to the obligation of confidentiality for criminal investigations, medical confidentiality or other professional confidentiality obligations. The law also establishes the principle of the independence of investigators and the publication of investigation reports. The BEA-TT was founded with the 2004 implementing ordinance for the law.

tasks

The main task of the BEA-TT is technical investigations of serious accidents or incidents in land transport and inland waterway transport. Furthermore, the BEA-TT should develop knowledge from such accidents and ensure that they are made known and disseminated.

His area of ​​activity includes rail traffic , other track-bound modes of transport ( tram , track bus , underground ), cable cars and ski lifts , road traffic , in particular freight traffic and public passenger transport, as well as shipping on inland waterways.

The decision to open a preliminary investigation by the BEA-TT is incumbent on its director. In the rail sector, the BEA-TT is obliged to comply with the obligations set out in EU Directive 2004/49 / EC on railway safety to initiate investigations.

The investigations of the BEA-TT cover all factors relevant to the respective case, including in particular human behavior and failure, the use and possible problems of the existing official regulations and regulations, the properties and condition of the structural infrastructure, the conditions under which they are operated and used, the condition and construction of the vehicles, the safety regulations and their handling, the training of the personnel and medical aspects.

The addressees of the safety recommendations issued by the BEA-TT are obliged to inform the BEA-TT of the measures they will take in response. The BEA-TT is entitled to make these answers public. However, it is not his job to monitor or control the implementation of the announced measures.
