The Congreso Constituyente de México 1821 was the constituent assembly for the first Mexican Empire under Agustín de Itúrbide .

It had its first meeting on February 24, 1822 and its last meeting on October 30, 1823, in the Extemplo de San Pedro y San Pablo , which is now the Museo de la Luz .

The Cabildos de Españoles of the newly independent New Spain met there .

As a constituent assembly, it was pouvoir constituant and part of the legislature . According to the Iguala plan , the form of government of the Mexican empire was to be the constitutional monarchy . It is the prototype for constituent assemblies, which in the history of the former New Spain were held in large numbers.

The monarchists orientated themselves on the constitution of Cadiz of 1812, whose meeting place was the Iglesia Mayor de San Pedro y San Pablo in Cadiz, while the proponents of a republic orientated on the constituent assembly.

Follow-up events

On November 7, 1823, another Congreso Constituyente was held in the Antigua Iglesia de San Pedro y San Pablo , which then drafted the first constitution of the Republic of Mexico. In somewhat more crude representations, both constituent assemblies are referred to together as the Congreso General de 1822-1824 , which takes into account the fact that the body experienced little change in personnel.

Benito Juárez had the Constituyente drawn up by a committee in 1857.

The 1917 constitution was drawn up at the Congreso Constituyente de Querétaro in Santiago de Querétaro .
