The DPA 1998 is a law that regulates the processing of personal data in the UK .

Historical background, legal history

In fact, at first common law did not have comprehensive protection of privacy. While there is minimal British data protection through the medium of individual areas of law, the DPA 1984 was nothing more than a response to the technical advances of the 1980s. However, the DPA 1984 could no longer meet the requirements of Directive 95/46 / EC (Data Protection Directive) and therefore had to be replaced by the DPA 1998.

The parliamentary procedure took place during 1998 and ended on July 16 with the Royal Assent . However, most of the regulations did not come into force until March 1, 2000.

The actors i. S. d. DPA 1998

The DPA 1998 knows u. a. the figures of the data controller, the data processor and the data subject. Data subject corresponds to the German data subject . The data controller of the responsible body.

Data protection principles

The substantive-legal core of the DPA 1998 are the eight data protection principles and thus the most important yardstick for the legality of data processing. A data controller is fundamentally obliged to follow each of the principles. A data subject can always demand compliance with these principles.

Data protection control (ICO)

The implementation of the DPA 1998 is monitored by the Information Commissioner (ICO for short), a data protection officer for Great Britain.
