Data Protection Commissioner

The Data Protection Commissioner (DPC) ( Irish An Coimisinéir Cosanta Sonraí ) is the head of the national data protection authority in Ireland .

The DPC is appointed by parliament and is independent of the government. The Office of the Data Protection Commissioner is located in Portarlington , County Laois . The authority itself does not have its own name, it only comprises a small staff and is called the DPC office . This authority became known throughout Europe because the Facebook subsidiary Facebook Ireland Limited is based in Ireland. This subsidiary is responsible for all matters affecting Facebook users from outside the USA and Canada , so DPC is responsible for disputes on the subject of data protection.

The legal basis is the Data Protection Act of 1998. The Data Protection Amendment Act of 2003 implemented Directive 95/46 / EC and improved data protection.

The tasks of the DPC are to monitor the law of the enacted laws and enforce sanctions against violations.

The incumbent DPC has been Helen Dixon since 2014. Her predecessor was Billy Hawkes. He was appointed in 2005 and sustained for an additional five year period in 2010. His predecessor was Joe Meade. The DPC is a member of the Article 29 Data Protection Working Party and the International Conference of Commissioners for Data Protection and the Protection of Privacy .

In the UK , this role is equivalent to the Information Commissioner .

criticism

The DPC came under fire in connection with the europe-v-facebook association, a group around the lawyer Maximilian Schrems . The association had submitted more than 20 reports against Facebook to the DPC in the summer of 2011 and withdrew everything 3 years later due to a lack of prospect of success, as the DPC had made decisions in favor of Facebook and had not responded to complaints without the association ever inspecting files or available Grant evidence.
