EU trust seal for qualified trust service providers
The single EU digital market and the enabling of cross-border public services.

eIDAS ( English e lectronic ID entification, A uthentication and trust S ervices ) in Germany also IVT ( electronic I dentifizierung and V ertrauensdienste Electronic T ransactions ) means Regulation (EU) no. 910/2014 of the European Parliament and of the Council on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93 / EC.

European level

The eIDAS Regulation (EU) No. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93 / EC regulates the use of trust services and electronic identification. The ordinance came into force on September 17, 2014 and has mainly been in force since July 1, 2016 (Art. 52 of the ordinance). Other parts apply when the implementing acts are applied.

Implementing acts

The eIDAS regulation is given concrete form at European level through implementing acts.

  • The implementing regulation (EU) 2015/806 specifies the form of a visual EU trust mark for qualified trust services,
  • Implementing Decision (EU) 2015/1505 formats for trust lists in which information about trust service providers (VDA) and the trust services they provide are provided by the competent authority in each member state,
  • Implementing Decision (EU) 2015/1506 defines formats of advanced electronic signatures and advanced seals that are recognized by public authorities and
  • Implementing Decision (EU) 2016/650 defines standards for the security assessment of qualified signature and seal creation units.

National level

Germany

Necessary for Regulation national regulations were effective as of July 29, 2017 by the eIDAS-implementation law made, in particular the law adopted by Article 1 Trust Services Act (VDG). A trust services ordinance shaping the VDG was issued on February 15, 2019 ( Federal Law Gazette I p. 114 ).

Austria

On July 1, 2016, the signature guideline and the signature law (SigG) expired, since then the eIDAS regulation has been applied with regard to signature and trust services.

Switzerland

Switzerland has also based its federal law ZertES on the eIDAS.
