ELiA (software)

ELiA ( Apronym of El ektronische i mmissionsschutzrechtliche A ntragsstellung) is a KoopUIS project different German states for the operation and further development of a program for the creation of applications and displays of the BimSchG .

The program enables plant operators to prepare their applications for an immission control permit in accordance with the BImSchG and to transmit them electronically to the competent authority with a legally binding signature with the help of a "virtual post office". The various types of permits as well as the notifications according to § 15 BImSchG are supported.

The program is executed in country-specific versions. The country-specific means different form contents, key tables, help texts and legal bases linked to the program as well as guides. The provision of the program is also organized independently by each federal state.

Involved federal states

Berlin, Brandenburg, Bremen, Hamburg, Mecklenburg-Western Pomerania, Lower Saxony, Saxony and Schleswig-Holstein are currently part of the state cooperation.

Approval process

According to § 5 forms 9th BImSchV , the licensing authority can request the use of forms for the application and the documents. In the mentioned federal states, the program or the forms must be used for BImSchG applications.

Changes to BImSchG systems must be reported in writing or electronically. §15 BImSchG does not contain any other formal requirements. There is no obligation to use the application program.

Electronic dispatch

General

A progressive, secure and, with a qualified signature, also legally binding way of sending the application electronically to the approval authority is to send it via a virtual post office.

The application file or the ZIP archive created from it contain the structured application data, the application as a PDF document and the attachments to the application.

An alternative to the virtual post EGVP is the Electronic Court and Administration Mailbox (EGVP). A secure exchange of data also takes place via the EGVP. The application file in the new applicationx format can also be transmitted to the approval authority in the conventional way, e.g. B. by CD / DVD or USB data carrier.

The transmitted data contains an XML file. This format can be read out by the authorities and transferred to other systems (e.g. LIS-A).
