According to canon law, the emeritus institution of the Archdiocese of Munich-Freising is a public legal entity and has the legal form of a corporation under public law .

The status as a corporation was recognized by a resolution of the Bavarian State Ministry for Education and Culture of July 14, 1923.

The emeritus institute pays its members pension payments during their retirement in accordance with the principles of civil service law . For priests, the regular retirement takes place at the age of 70.

In order to fulfill its task, the retirement institution was provided with real estate and financial assets by the Archdiocese of Munich-Freising.

The emeritus institution also receives grants from the Free State of Bavaria , agreed in the Bavarian Concordat from 1924, and the Archdiocese of Munich-Freising. The Free State of Bavaria adhered to these regulations with the Act for the Execution of Concordat and State Church Contractual Obligations (AGKStV) and the agreement between the Free State of Bavaria and the seven Roman Catholic (arch) dioceses in Bavaria of December 15, 2014.

administration

According to § 14 of the statutes of January 1, 2016, the administration of the emeritus institution is carried out by the Archbishop's Finance Director with the help of the Archbishop's Chamber of Finance. The Archbishop's Finance Director represents the emeritus institution internally and externally.
