Development risk

Development risk refers to a risk emanating from a product that was not recognizable according to the state of the art in science and technology at the time the product was placed on the market . The manufacturer is only liable for the development risk if a special law (e.g. the Medicines Act ) provides for a corresponding liability obligation ( Section 1 (2) No. 5 of the Product Liability Act ).
