The Product Liability Act (Act on Liability for Defective Products - ProdHaftG) of December 15, 1989 ( Federal Law Gazette I p. 2198 ) regulates the liability of a manufacturer in Germany for defective products. The law understands this to mean all movable objects , even if they form part of another movable or immovable object, as well as electricity. Medicines regulated by the Medicines Act are excluded from the Product Liability Act .

In Article 19 (1) of EC Directive 85/374 / EEC, the deadline for enacting national law for implementation was set at three years from the date of notification. The announcement took place on August 7, 1985. The Product Liability Act was only enacted on December 15, 1989, more than a year late.
