Explanatory principle (administrative procedure)

The declaration principle is a principle in the administrative procedure that states that an authority can proceed from the declarations of an applicant if the information provided is plausible and there is no specific reason for a review. The principle of official investigation does not then require further investigation.

The principle of explanation is not regulated as such in the law ; the term is not mentioned in any law. Its content results from the regulations on the investigation obligations of the authorities (e.g. § 20 SGB ​​X investigation principle). It is specified in the administrative regulations and instructions issued by the responsible ministries or supervisory authorities .
