The German Food Security and Prevention Act ( ESVG ) aims to ensure an adequate supply of food and agricultural products in the event of a supply crisis .

history

The law's precursors were the Preventive Food Act and the Food Security Act. The Food Prevention Act was enacted as a result of the Chernobyl disaster . It only applied to non-military supply crises, such as those threatening natural disasters or strikes. In the case of a defense , however, the Food Security Act applied.

Both laws were merged in 2017 in the new Food Security and Provisioning Act.

According to Section 1 (1) of the Act, there is a supply crisis

if the federal government has determined that

1. The coverage of the vital need for food in essential parts of the federal territory is seriously endangered
a) in the event of tension according to Art. 80a of the Basic Law or in the event of a defense according to Art. 115a of the Basic Law or
b) as a result of a natural disaster, a particularly serious accident, an act of sabotage, an economic crisis or any other comparable event and
2. this threat cannot be eliminated, cannot be eliminated in good time or can only be eliminated with disproportionate means without sovereign intervention in the market.

If the Federal Government determines that such a crisis has occurred, various state control measures can be issued to avert the consequences of the crisis.

A pandemic can also be considered a natural disaster .
