Education pension
The education pension is a type of pension in the system of the German statutory pension insurance .
The pension regulated in Section 47 Sixth Book of the Social Code (SGB VI) is, by definition, one of the pensions due to death . In contrast to the survivor's pension, it is not paid out of the pensionable time of the deceased, but of the recipient.
Entitlement to an education pension exists if
- the surviving dependents paid pension contributions for at least five years
- and the marriage was divorced , declared null and void or annulled from June 30, 1977 - or if the marriage was dissolved before July 1, 1977 GDR law applied to the maintenance claim
- and the divorced spouse died as long as you were raising your own child or a child of the deceased (including stepchild, foster child, grandchildren, siblings) who was not yet 18 years of age. The same applies to a disabled own child or the child of the former spouse, regardless of the age of the child.
- and the pension recipient has not yet reached the standard retirement age .
- and one remained unmarried and did not enter into a registered civil partnership.
Income is credited in the same way as the widow's pension in accordance with Section 97, Book Six of the Social Code . Widowed spouses for whom a pension has been split are also entitled to an education pension . Registered civil partnerships are on an equal footing with marriage.
