The sixth book of the Social Security Code ( SGB ​​VI ) contains the law of statutory pension insurance in Germany . It essentially came into force on January 1, 1992. It replaced the pension insurance regulations of the Reich Insurance Code (RVO), the Employees Insurance Act (AVG) and the Reichsknappschaftsgesetz (RKG).

As a result of the law on organizational reform in the statutory pension insurance of December 9, 2004 ( Federal Law Gazette I p. 3242 , coming into force on January 1, 2005), significant changes have occurred since October 1, 2005, especially in the area of ​​responsibilities and structure (see German Pension insurance ).

UBS VI is divided into six chapters, these in turn into sections and, if necessary, also into subsections and titles. It also currently contains 20 attachments.

First chapter (§§ 1 to 8) - Insured persons

The first chapter of SGB VI is divided into three sections:

  1. Sections 1 to 6 : Insurance by law
  2. § 7 : Voluntary Insurance
  3. § 8 : Follow-up insurance, pension adjustment and pension splitting

Second chapter (§§ 9 to 124) - Services

The second chapter is divided into six sections:

  1. §§ 9 to 32 : Benefits for participation
  2. Sections 33 to 105a : Pensions (including periods under pension law and pension calculation)
  3. Sections 106 to 108 : Additional services
  4. Sections 109 and 109a : Services
  5. Sections 110 to 114 : Benefits to beneficiaries abroad
  6. Sections 115 to 124 : implementation

Third chapter (§§ 125 to 152) - Organization, data protection and data security

The third chapter has two sections:

  1. Sections 125 to 145 : Organization of pension insurance (including responsibility of the various insurance carriers)
  2. Sections 147 to 152 : Data protection and data security

Fourth Chapter (§§ 153 to 227) - Financing

The fourth chapter is divided into three sections:

  1. Sections 153 to 156 : Financing principle ( pay-as-you-go system ) and pension insurance report
  2. Sections 157 to 212b : Contributions and procedures
  3. Sections 213 to 227 : Federal participation, financial relationships and reimbursements

Fifth Chapter (Sections 228 to 319c) - Special regulations

Due to numerous changes in the law and the associated property protection regulations, the revoked law continues to apply under certain conditions. This is bundled in the fifth chapter and is divided into two sections:

  1. Sections 228 to 299 : additions for special cases
  2. Sections 300 to 319c : Exceptions to the application of new law

Sixth Chapter (Sections 320 and 321) - Administrative fines
