Eurasian Patent Organization

The Eurasian Patent Organization ( EAPO ) is an intergovernmental organization created by the Eurasian Patent Convention with headquarters in Moscow , to which nine member states, which are all successor states of the Soviet Union , belong. The official language is Russian .

The Eurasian Patent Organization is very similar to the European Patent Organization .

Eurasian Office

The most important body of the EAPO is the Euro-Asian Patent Office (EAPA) or Eurasian Office , whose task is to examine and grant Eurasian patents . The EAPA is also based in Moscow .

By the end of 2004 , 9,577 patent applications had been filed and 5,571 patents were granted.

The EAPO does not receive any tax money, but finances itself from the procedural and annual fees, gifts, subsidies, etc .; possible surpluses are used to develop the office. It is to be expected that this, as with the EPO, will lead to criticism that the Office has an interest in the granting of trivial patents .

The 86 (as of 2004 ) employees of the Eurasian Patent Office are mainly nationals of the EAPC contracting states.

The Eurasian Patent Office includes the following departments:

  • Search departments that prepare the search reports on the applications
  • Examination departments for the substantive examination of applications and the granting of patents
  • a legal department
  • a department for international cooperation

Eurasian patents

Following a centralized procedure, Eurasian patents are granted with effect for the territory of all member states. However, it is not a single patent; in the event of extensions, the validity can be limited to individual contracting states (saving fees); in addition, a patent can be declared null and void in the courts of a country with effect only for that country.

The EAPA is supervised by an administrative board (Art. 3 Para. 3 EAPC), which is the second body of the EPO and consists of representatives and their deputies sent by the member states (Art. 3 Para. 1 EPC).
